TERMS & CONDITIONS – RED THREAD REDUX BESPOKE ARTISAN JACKETS

1. Introduction

These Terms & Conditions govern the sale and creation of bespoke, custom-made artisan jackets by Red Thread Redux ABN: 39251853165 to you, the Customer. By placing an order, you agree to be bound by these terms.

2. The Service – "You Supply the Jacket. We Supply the Art."

- Red Thread Redux provides a customisation and up-cycling service only.

- You are responsible for sourcing and supplying the base jacket.

- We do not supply or guarantee the fit, quality, or condition of the base jacket you provide.

- You warrant that the jacket you send is clean, in good wearable condition, and has been inspected by you for any structural flaws, stains, or odours prior to shipment.

3. Order Process

- Purchase: You purchase your chosen tier (The Studio, The Couture, or The Reclamation) via our website.

- Order Form: Within 48 hours of purchase, we will email you a personalised order form. You must complete this form to specify your chosen ingredients from our mix list.

- Jacket Submission: You must post or deliver your jacket to our studio within 14 days of completing your order form. Our studio address will be provided in your confirmation email. We take no responsibility for the jacket whilst in transit to us.

- Inspection: Upon receipt of your jacket, we will inspect it for suitability. If we deem it unsuitable (e.g., severe stains, holes, fabric disintegration, or poor structural integrity), we will contact you to discuss alternatives. If no alternative is agreed upon, we will return your jacket at your expense and issue a full refund of the service fee.

4. Customisation & Ingredients

Your final jacket will be created based on the selections you make in your order form.

- The Studio: Up to 3 ingredients from our mix menu.

- The Couture: Up to 5 ingredients from our mix menu.

- The Reclamation: A minimum of 5 ingredients, plus custom artwork, lettering, or illustration as determined by our creative discretion based on your brief.

- We reserve the right to make minor artistic adjustments to ensure balance and structural integrity. We will not add any major elements not listed on your form without your prior consent.

5. Intellectual Property & Ownership

- All artwork, stitching, spray designs, and embellishments applied to your jacket remain the intellectual property of Red Thread Redux.

6. Cancellation & No-Refund Policy (Bespoke Goods)

Under Australian Consumer Law, bespoke and custom-made goods are generally exempt from the "consumer guarantees" relating to returns and refunds for change of mind. Our policy is as follows:

- Cooling-Off Period: You may cancel your order within 48 hours of receiving your purchase confirmation email. You will receive a full refund (minus any payment processing fees).

-Form Submission: Your submission form must be received within 7 days of purchase.

- Once we have received your jacket; And we have commenced any artwork (including spraying, stitching, cutting, or embellishing), all sales are final. No refunds will be issued for change of mind.

- Exceptions: This policy does not limit your rights under the ACL for major failures—for example, if we damage your jacket through negligence, or if we fail to deliver the service we promised (e.g., using the wrong ingredients). In those rare cases, we will resolve the issue at our cost.

7. Shipping & Delivery

- Shipping to Us: You are responsible for all shipping costs, insurance, and tracking when sending your jacket to our studio. We are not liable for loss or damage during transit to us.

- Shipping to You: We will ship your finished jacket back to you via a tracked courier service. Shipping costs are calculated at checkout and are the responsibility of the Customer. We will notify you with a tracking number once dispatched.

- Turnaround Time: Our standard production time is [Insert weeks – e.g., 6–8 weeks] from the date we receive your jacket. Delays may occur due to the complexity of the work or material availability. We will update you via email if any delays arise.

8. Liability & Insurance

- While we take the utmost care with your jacket, we recommend you insure your jacket for its full value during transit to us.

- Red Thread Redux is not liable for any pre-existing defects in your jacket (e.g., hidden tears, weak seams, fading) that only become apparent during our process.

- We do not accept liability for minor variations in fabric colour due to spray techniques; due to the handcrafted nature of our work, each piece will have unique tonal variations.

- Our maximum liability for any claim (excluding personal injury) is limited to the total amount paid by you for the service.

9. Customer Responsibility

By placing an order, you confirm that:

- You are over 18 years of age.

- You have read and understood these Terms & Conditions.

- You have the right to supply the jacket and grant us permission to alter it.

- You understand that the final product may differ slightly from mock-ups or visual references due to the handmade nature of the process.

10. Privacy

11. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be effective upon posting to our website. Your continued purchase constitutes acceptance of the new Terms.

12. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes shall be resolved exclusively in the courts of New South Wales.
